1. Acceptance of these terms

By accessing or using PollenTracker, you agree to these Terms of Service. If you do not agree, do not use the service.

You must use PollenTracker in compliance with applicable laws and these terms.

2. What PollenTracker provides

PollenTracker provides pollen, air quality, weather, and symptom-tracking features intended to help users make day-to-day outdoor planning decisions.

We may update, improve, limit, or discontinue features at any time.

3. No medical advice

PollenTracker is an informational tool only and does not provide medical advice, diagnosis, or treatment.

You should consult a qualified healthcare professional for any medical concerns or health-related decisions.

4. Daily email alerts

PollenTracker's website forecasts remain available without an account. Daily email alerts are available on a free plan after email confirmation. Free emails may include one clearly labeled sponsor message.

You are responsible for providing an email address that you control and for keeping your billing information current. You may unsubscribe from alert emails at any time.

5. Acceptable use

You may not misuse the service, interfere with normal operation, attempt unauthorized access, reverse engineer protected parts of the service, or use automated methods to scrape the service in a way that harms stability or availability.

You may not use PollenTracker in a way that violates law or infringes the rights of others.

6. Data sources and availability

Forecasts and environmental data may come from third-party providers. That data can be delayed, unavailable, incomplete, or inaccurate.

We do not guarantee continuous availability, uninterrupted operation, or error-free forecasts.

7. Paid features and subscriptions

PollenTracker Pro removes sponsor messages from Daily Alerts and costs $19 USD/year unless a different price is clearly shown at Checkout. The subscription renews automatically each year until canceled. Applicable taxes may be added at Checkout.

Stripe processes payments and provides the hosted billing portal. You can cancel automatic renewal at any time through that portal; cancellation takes effect at the end of the current paid billing period unless applicable law requires otherwise.

Except where required by law, payments are non-refundable and we do not provide prorated refunds for a partially used billing period.

Subscribers who began receiving free alerts before paid subscriptions launched may continue under their existing complimentary access. That access is not transferable, has no cash value, and may be ended if the email address becomes undeliverable or the service is discontinued.

8. Intellectual property

PollenTracker, including its software, branding, content, and design, is owned by or licensed to us and is protected by applicable intellectual property laws.

These terms do not grant you ownership of the service or any related intellectual property rights.

9. Disclaimer of warranties

PollenTracker is provided "as is" and "as available" without warranties of any kind, express or implied, to the extent permitted by law.

We disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, PollenTracker and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, or goodwill arising from your use of the service.

If liability cannot be excluded, our total liability will be limited to the amount you paid us for the service during the 12 months before the event giving rise to the claim.

11. Changes to these terms

We may update these terms from time to time. When we do, we will update the effective date on this page.

Your continued use of PollenTracker after updated terms take effect means you accept the revised terms.

12. Governing law

These terms are governed by the laws applicable in the jurisdiction where the service operator is established, excluding conflict-of-law rules.

If any provision is found unenforceable, the remaining provisions will remain in effect.
